Terms of service

Faktuno is a service for businesses. By creating an account or paying for a subscription you accept these terms. Questions? Write to hello@faktuno.be.

1. Who we are

Faktuno is provided by Tomas Lambermont Consulting, Rodestraat 94, 1570 Galmaarden, Belgium, enterprise number 1001.751.662, VAT BE1001751662 (“we”, “us”).

2. The service

Faktuno is online software to create invoices and credit notes and to send and receive them as electronic documents through the Peppol network. We deliver documents through a certified Peppol access point (currently Recommand). Faktuno is not an accounting or tax advisory service.

3. Who can use Faktuno

Faktuno is only for businesses and self-employed professionals acting for their business, with a Belgian enterprise number. It is not offered to consumers. You confirm that the details you give us are correct and that you are allowed to act for the business you register.

4. Your account

You log in with a one-time link sent to your email address. Keep your mailbox and devices secure. You are responsible for what happens in your account. Tell us immediately if you think someone else has access.

5. Plans, prices and payment

  • Starter: €8 per month, up to 30 documents per calendar month.
  • Pro: €15 per month, up to 100 documents per calendar month.
  • Extra documents: €8 for 50 additional documents, valid in the month you buy them.

Free trial. New accounts get a free trial of 14 days with the documents of the chosen plan. To start the trial you add a payment method through Mollie; we charge €0.02 to confirm it (not refunded) and give you permission to charge the subscription automatically. If you do not cancel before the end of the trial, the first monthly payment is taken on the day the trial ends. One trial per business.

A “document” is an invoice or credit note you send, or a document you receive through Peppol in Faktuno. Prices exclude VAT, which is added at the applicable rate (currently 21%). Subscriptions are paid monthly in advance through our payment provider Mollie and renew automatically each month until cancelled. If you change plan, the new monthly limit applies immediately and the new price from your next monthly payment. You receive an invoice for every payment. We may change prices with at least 30 days’ notice by email; the new price applies from your next billing period after that notice, and you may cancel before it takes effect.

6. Usage limits and fair use

When you reach the documents included in your plan, sending pauses until the next calendar month unless you buy extra documents or upgrade. To protect the service and the Peppol network, we also apply technical limits on how many documents can be sent per minute and per day. You agree not to:

  • send documents that are not genuine invoices or credit notes, or that are fraudulent, misleading or unlawful;
  • use Faktuno for bulk or automated sending on behalf of third parties, or resell access to Faktuno;
  • attempt to get around limits, access other customers’ data, or disrupt the service.

If usage is clearly beyond normal use for your plan, we will contact you to agree a suitable plan. We may suspend sending if there is a serious breach or a risk to the service or the network.

7. Cancellation and refunds

  • You can cancel your subscription at any time from your account or by emailing hello@faktuno.be. There is no minimum term and no cancellation fee.
  • Cancellation takes effect at the end of the month you have already paid for, or at the end of your free trial. You keep full access until then; if you cancel during the trial, you are not charged.
  • If a monthly payment fails, Mollie retries it; you keep access for a few days while you update your payment method.
  • Payments for a month that has started are not refunded, and unused documents or extra documents are not refunded or carried over.
  • If you were charged by mistake (for example, twice for the same period, or after a cancellation that had taken effect), we refund the incorrect amount in full to your original payment method within 14 days.
  • If Faktuno is unavailable for a significant part of a month because of a problem on our side, contact us and we will refund or credit that month fairly.
  • Because Faktuno is offered only to businesses, the consumer right of withdrawal does not apply.

After your account ends, you can download your data for 30 days. After that we delete it, except where we must keep it by law (for example our own billing records).

8. Your responsibilities

You are responsible for the content of your invoices and credit notes: the amounts, VAT treatment, legal mentions and your client’s details. You remain responsible for keeping your invoices for the period required by law; download or export them regularly. Faktuno helps with checks, but does not replace your accountant.

9. Peppol delivery

We send your documents to the Peppol address of your client. Delivery depends on your client being registered on Peppol with correct details and on their provider. We show you whether a document was accepted by the network. We are not responsible for how your client’s provider or software processes a document after delivery.

10. Availability and support

We do our best to keep Faktuno available at all times, but we cannot guarantee uninterrupted service. Maintenance and incidents at our suppliers (hosting, Peppol access point, payments) may cause interruptions. Support is provided by email on Belgian working days.

11. Data protection

How we handle personal data is explained in our privacy policy. Where invoices or other documents you create contain personal data of your clients or suppliers, we process that data on your behalf and only on your instructions, as your processor under Article 28 GDPR: we keep it confidential, protect it with appropriate security measures, only use sub-processors listed in our privacy policy, help you respond to requests from data subjects, inform you without undue delay of a personal data breach, and delete or return the data when your account ends.

12. Liability

Our total liability for any claim related to Faktuno is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect damage such as lost profit, lost revenue or lost data, nor for fines or penalties resulting from the content of your documents. These limits do not apply to fraud, intentional misconduct or where the law does not allow them.

13. Suspension and termination

We may suspend or end your account if you seriously breach these terms, do not pay, or use Faktuno unlawfully. Except in urgent cases, we will warn you first and give you a reasonable time to fix the problem.

14. Changes to these terms

We may update these terms. We will tell you about important changes by email at least 30 days before they apply. If you do not agree, you can cancel before the changes take effect.

15. Law and disputes

These terms are governed by Belgian law. We will first try to resolve any dispute amicably. If that fails, the courts of the judicial district where Tomas Lambermont Consulting has its registered office have jurisdiction.
